Danielsen Transparent Hiring Bill Signed Into Law

A bill that would require employers to advertise employment openings to employees in the relevant department before making a hiring decision was recently signed into law by Gov. Phil Murphy.

The bill’s primary General Assembly sponsor was Assemblyman Joe Danielsen (D-17.)

The bill’s intent is to to foster greater fairness in the workplace, according to a press release about the measure.

The bill “aims to increase access to career advancement opportunities through internal and external advertisements, postings, and flyers,” according to the release.

“Far too often, employees are uncertain or unaware of opportunities for growth and added compensation and this bill is designed to change that,” Danielsen said in the release. “Every employee deserves a fair chance at advancement, and this bill will provide an extra resource in making sure job promotions are well publicized.”

The bill was co-sponsored in the Assembly by Assemblywomen Annette Quijano (D-20) and Tennille R. McCoy (D-14).

“Nobody deserves to be overlooked when it comes to promotional opportunities and this legislation is about ensuring fairness in the workplace,” Assemblywoman Quijano said in the release. “A4151 will help level the playing field by protecting employees from favoritism and assisting them in understanding their potential for growth from the start.”

“As a Human Resources executive, I am dedicated to ensuring that every employee has equal access to promotions and a clear understanding of their compensation and benefits, as this is essential for fostering a more equitable workplace,” Assemblywoman McCoy said in the release. “During my tenure as Assistant Commissioner with the Department of Labor and Workforce Development, I implemented policies that mandated all newly created positions and promotions be publicly posted, allowing qualified internal candidates the opportunity to interview. I firmly believe that empowering both employers and employees to make informed decisions fosters an environment where advancement is based on merit rather than hidden information.”
